Website Privacy Policy

Last updated: 5 November 2026

This policy covers the website at brainsoft-apps.com only: people who browse it, and people who send a publishing application. It does not cover our mobile apps and games. Those are described in the privacy policy.

Who we are

The controller is Genioworks Consulting & IT-Services UG (haftungsbeschränkt) (“Genioworks”, “we”, “us”).

Cookies and similar technologies

The cookie banner has three categories. They match the controls on the banner.

Category What it is When it runs Legal basis
Essential Required for the site to function, including storing your cookie choice in this browser. Always on. You cannot switch it off. Always Strictly necessary to provide the site you asked for.
Analytics Google Analytics 4. Anonymous usage statistics. EEA, UK and Switzerland: only after you opt in. Elsewhere: on until you opt out in the banner, unless Global Privacy Control is set and you have not saved a choice. Consent (Art. 6(1)(a) GDPR and UK GDPR) in the EEA, the UK and Switzerland.
Advertising OpenAI Pixel. Conversion and campaign measurement.

We treat the European Economic Area, the United Kingdom and Switzerland as opt-in regions. We infer the region from the browser time zone. If we cannot read the time zone, we ask before Analytics or Advertising run. In every other region, Analytics and Advertising are on by default and you can turn them off in the banner, unless the browser sends Global Privacy Control and you have not saved a choice. In that case they stay off until you accept. Use Reject all, or Customize and switch a category off, then save. You can reopen the banner at any time with Manage cookies in the footer.

Your choice is stored in this browser under the key cookie-consent:v1 until you change it or clear site data. We do not keep a separate server copy of that choice.

Global Privacy Control

If the browser sends Global Privacy Control (navigator.globalPrivacyControl === true) and you have not already saved a choice, we do not enable Analytics or Advertising. That signal is treated as a rejection. The banner stays available so you can still choose Accept all, Reject all, or a custom mix. A choice you have already saved is not overwritten by the signal.

Google Analytics 4

Google Analytics 4, provided by Google, measures how the site is used (for example pages viewed and general traffic). Google’s privacy policy is at policies.google.com/privacy. We load the Google tag only after Analytics is allowed.

OpenAI Pixel

The OpenAI advertising pixel is provided by OpenAI, OpenCo LLC (US). We use it to measure advertising and conversions, for example when you reach certain pages. It uses cookies and similar technologies and can process your IP address, device and browser information, and interactions on this website. OpenAI’s privacy policy is at openai.com/policies/privacy-policy. We load the pixel only after Advertising is allowed.

Publishing applications

If you apply to have an app published, the form asks for:

  • your name;
  • your email address;
  • the app or game name;
  • the platform (iOS, Android, or both);
  • the development stage, if you select one;
  • a link to the app, a demo or a video, if you provide one;
  • a short description of the project.

The form asks you to consent before it is sent. The legal basis is consent, Art. 6(1)(a) GDPR. You can withdraw that consent by emailing info@brainsoft-apps.com. Withdrawal does not affect processing that took place before it, and it does not erase records we must keep. We use the information to read the enquiry, reply, and decide whether to take the project further.

The form is submitted through Web3Forms, which receives the fields above and delivers the enquiry to us. Where the form shows an hCaptcha challenge, hCaptcha runs that check to block automated submissions and receives the technical data it needs to do so. hCaptcha’s privacy policy is at hcaptcha.com/privacy.

We keep a publishing enquiry until we have handled it, and for a short archive after that so we can find the correspondence if you write again or if we need to show what was sent.

Children

The website is not directed at children under 16. We do not knowingly collect personal data from children under 16. In the United States we do not knowingly collect personal information from children under 13. If you believe a child has sent personal data through the site, email info@brainsoft-apps.com and we will delete it.

International transfers

We are established in Germany. Google and OpenAI process website measurement data in the United States. Web3Forms, and hCaptcha where the form shows it, may process a publishing application outside the EEA. Where we transfer personal data from the EEA, the UK or Switzerland, we use one or more of the following:

  • an adequacy decision, where the destination is covered;
  • standard contractual clauses adopted by the European Commission, and the UK or Swiss equivalent where that transfer needs it;
  • the EU-US Data Privacy Framework, and the UK extension and the Swiss-US Data Privacy Framework, where the recipient is certified for that framework.

You can ask us which safeguard applies to a given transfer. We rely on a Data Privacy Framework only where the recipient’s certification covers that transfer.

United States state privacy rights

This section is about the website, not the apps. If you live in a US state that gives residents privacy rights, you may have the right to access, correct and delete personal information, to receive a portable copy, to opt out of sale, sharing and targeted advertising, and to appeal a refusal where that state’s law provides an appeal. We will not discriminate against you for exercising these rights.

On this website, the sale or sharing is the use of Google Analytics 4 and the OpenAI Pixel, which can disclose identifiers and site activity for analytics and advertising measurement even when no money is paid for the data. Opt out in the cookie banner (Reject all, or switch Analytics and Advertising off) and by using Global Privacy Control, as described above. A choice already saved in the browser is kept. Email info@brainsoft-apps.com for any other request. We may need to confirm that it comes from you.

Rights in the EEA, the UK and Switzerland

If the GDPR or the UK GDPR applies, you can ask for access, correction, deletion, restriction and a portable copy, object to processing based on legitimate interest, and withdraw consent. Withdrawal does not affect processing that took place before it.

Email info@brainsoft-apps.com. We may ask for information we need to confirm it is your data. We do not charge a fee for a reasonable request. We reply within one month.

You can lodge a complaint with the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW), ldi.nrw.de, and with the data protection authority where you live.

Automated decisions

We do not make decisions based solely on automated processing that produce legal effects or similarly significant effects for you. hCaptcha, where it is shown, only blocks suspected automated submissions. It does not decide whether we publish a project.

Security

We use encryption in transit, limit access to people who handle enquiries, and rely on the browser to store your cookie choice on your device. No method of transmission or storage is completely secure.

Changes

We may update this policy. The date at the top is the date of the current version. If a change affects cookies, the banner is where you set a new choice.
